TERMS & CONDITIONS
The Beyond Travel Group is fully accredited with the AFTA Travel Accreditation Scheme (ATAS) and is a member of the Council of Australian Tour Operators (CATO – member TO1039) and Australian Federation of Travel Agents (AFTA).
These Booking Conditions set out the terms on which you contract with us. By placing a booking request, you acknowledge that you have read, understood and agree to be bound by these booking conditions.
“You” and “Your” means all persons named in the booking (including anyone who is added or substituted at a later date). “Beyond Travel”, “we”, “us” and “our” means Beyond Travel Group Pty Ltd trading as Beyond Travel.
Except where otherwise stated, these booking conditions only apply to travel arrangements which you book with us and which we agree to make, provide or perform (as applicable) as part of our contract with you. All references in these booking conditions to “tour”, “services”, “booking”, “contract” or “arrangements” mean such travel arrangements unless otherwise stated.

VALIDITY, PRICES & GST
This website is valid from 1 August 2019 – 31 December 2020, unless withdrawn or substituted earlier.
All published rates are in Australian dollars and include GST where applicable and are subject to change prior to us accepting your booking. We reserve the right to increase the price of your booking following confirmation due to increases in taxes and other government charges, negative currency fluctuations, airline fuel surcharges or for any other increases in the costs of delivering your travel arrangements beyond our reasonable control. Prices are protected against currency fluctuation surcharges once payment is received in full, but remain subject to increase due to any tax changes or levies imposed by any government or their agencies or any airline.
2020 DISCOVER MORE TRAVEL VOUCHERS
Bonus Discover More Travel Vouchers are offered on select services when deposited and/or paid in full as outlined in our brochures and on website promotions. The value of the voucher will vary by service, as outlined on the web pages and in the brochures.
Travel Voucher Validity:
Your vouchers can be redeemed against ANY additional Beyond Travel service featured in ANY of our SIX 2020 brochures or FIVE websites, from pre or post tour hotels throughout India, Sri Lanka and Maldives packages – to – small ship cruises in Croatia, tours of Russia, and so much more…there are hundreds of options to choose from. Additionally; If you require a stopover en-route to Sri Lanka or India, such as in Singapore or Malaysia or China, just let us know and we will offer voucher redemption against these services when booked with us.
Redemption expires 31 December 2020; all services must be booked and outstanding payments made by this date – However, your travel dates can be later until end of June 2021, and extensions for travel beyond June 2021 maybe available on request and at our discretion, as long as all services are booked prior to expiry.
Please note Discover More Travel Vouchers may not be combinable with any other offer, are invalid if the tour for which it was issued is cancelled, and have no cash value. Refunds can not be issued on unused amounts.
Single Traveller Offers:
Single travellers generally receive 50% of the per couple voucher amount unless otherwise specified (we give you more when we can!).
Not Able To Use Your Travel Voucher?
We are happy to assist you, for instance to transfer your voucher and share your bonus, with your friends and family. To do this please email firstname.lastname@example.org – simply quote your booking reference and ask to “share your voucher”. We will send you a quick form to fill in along with the additional terms to prevent fraud and “double dipping”. We re-iterate; Discover More Travel Vouchers have no cash value and no refunds will be issued for any unused amounts.
Cant find what you need?
Just let us know and we will be happy to consider extending voucher redemption to services not featured in our brochures or on our websites, such as: additional hotels, rail passes, stopovers and air tickets in select destinations. In particular stopover hotels and packages en-route in Singapore, Malaysia and China are popular and readily available on request. Additional options in the Maldives or Seychelles are also available. We will do our best to assist you with any special request, although redemption against services not featured on our websites or in our brochures is not always possible, at our sole discretion and on a request basis only. Requests must be received before your voucher expires on 31 December 2020.
HOW TO BOOK
To book any service on this website, please contact Beyond Travel or your preferred travel agent.
To secure a booking, a non-refundable deposit of 25% (cruise) or 10% (all other services) will be required within 7 days upon receipt of a confirmation invoice (unless otherwise specified at time of booking).
Final payment is due 60 days before the commencement of the first travel service. We are under no obligation to remind you of payments becoming due. If you not make your final payment by this deadline, we reserve the right to cancel your booking and cancellation fees (as specified below) will apply.

Payment is available by Credit card (Direct or via Pay Pal) for security and convenience we recommend Pay Pal. Alternately payment by direct deposit is available via Western Union, details will be outlined on your invoice.
AMENDMENTS BY YOU
We will endeavour to accommodate changes and additional requests. You acknowledge that changes and requests may not be possible to fulfill. If we are able to fulfil any changes or requests, you agree that a fee of $55 will be payable at the time we confirm the amendment.
AMENDMENTS BY US
Every effort will be made to adhere to the published touring itinerary. We reserve the right to substitute hotels for hotels of a comparable standard.
Occasionally, circumstances beyond our control will force changes, amendments or modifications to the itinerary and its inclusions. To the fullest extent permitted by law, we will not be responsible for any omissions or modifications to the itinerary or the inclusions made as a consequence of these circumstances.
If you are entitled to any compensation at law for any changes or modifications in these circumstances, then you agree that any compensation you are entitled to will be reduced by the value of any alternative services we provide that you accept. If because of these amendments additional hotel nights (outside of the included tour dates) or flights are required, then we will pass these costs on to you which you agree to pay.
Beyond Travel disclaims any liability to you for the costs of airfares, visas or any other expenses incurred by you as a result of any amendment or change to the tour itinerary.
CANCELLATION BY YOU
Once your booking has been confirmed, we will only accept cancellations in writing and the following charges will apply, unless otherwise advised:

Note that charges for visa support documentation and rail, coach and theatre tickets are non-refundable once issued or purchased. Airline tickets and rail passes which have been issued are subject to cancellation fees imposed by the airline or rail company. These cancellation charges will be passed on to you.
CANCELLATION BY US
Events outside our control: If a tour cannot proceed due to flood, earthquake, war or civil strife, acts of terrorism, hurricane, cyclone, industrial disturbance, strike, fire, lock out, epidemic, pandemic, failure or delays of scheduled transportation facilities, or other acts of god, or any law, order, decree, rule or regulation of any government authority, or for any reason whether of a similar or dissimilar nature beyond the control of Beyond Travel (Force Majeure), our contract with you will terminate and there will be no claim for damages by either party against the other, provided that we will refund you any payments made by you that we have not expended (or legally committed to expend) minus an administrative fee of $200 per person. If we provide you with any alternative services or assistance where a tour is cancelled because of Force Majeure, then you agree the amount to be refunded to you will be reduced by the value of these services and assistance.
Operational reasons: We may cancel a tour for reasons beyond Force Majeure at any time up to 4 weeks before the commencement of your scheduled travel arrangements. If we cancel a tour for operational reasons, we will endeavour to offer you alternative arrangements (and if the alternative arrangements are of lower value and you accept them, then we will refund you the difference). If we do not offer you any alternative arrangements, then we will refund you all amounts paid at the time of cancellation.
No liability for other costs
Beyond Travel will not be responsible for any other travel arrangements affected by, or any additional costs incurred as a result of our cancellation, including costs of airfares, visas or other expenses incurred by you as a result of our cancellation.
No refunds will be made for any tours, meals, accommodation, sightseeing, transfers, or any other services included in the tour cost, which you do not utilise, if you are a “no show”, choose voluntarily not to use the service, if you decide to leave the tour early, or if you are excluded from the tour due to your behaviour or health. No overseas supplier or tour leader is authorised to promise a refund on our behalf. All claims for refunds or reimbursements must be received in writing within 3 weeks from the date the service was provided.
HOTEL, SHIP, AIR, RAIL & ITINERARY CHANGES
Beyond Travel and its principals will do everything possible to make sure your holiday goes according to plan; however, sometimes an unforeseen event occurs to cause changes to itinerary, hotel, rail or vessel in which case an alternative of similar standard will be arranged. Beyond Travel will notify you on these changes as soon as possible, but be under no further obligation.
1a: (+) This website offers a choice of 5 grades of accommodation: 3 Star, 4 star, 5 star, Heritage and Luxury. Wherever possible your accommodation will be in a hotel that corresponds
with the grade selected. However, in some locations where no suitable hotel in your chosen category is available you will be accommodated in an alternative category. These are shown on the itineraries and your price is reflective of this change.

Discounts apply to bookings either deposited or paid in full by the dates indicated. Savings amounts will vary by service. Featured savings are total per couple; great value early bird discounts are also available for solo travellers. Please contact Beyond Travel for further details.
Documentation is normally forwarded to you or your travel agent approximately 3-4 weeks before the commencement of your service. If you require documents more than 4 weeks before commencement of your service, please advise Beyond Travel or your travel agent at the time of booking.
PASSPORTS, VISA & VACCINATIONS
Australian and New Zealand citizens must hold a current passport Important: Many countries require your passport is valid for 6-months from the date you arrive OR intend to depart that country, be sure to check your passport validity meets each countries requirements. It is the responsibility of the individual to obtain the required visas prior to departure and ensure they hold the required travel documents for each country visited. Failure to do so which results in the need to cancel travel arrangements will incur normal cancellation penalties. It is your sole responsibility to obtain vaccinations and preventative medicines as may be required for the duration of the tour. Any information provided by us is given in good faith and may not be relied upon as being accurate and does not constitute formal advice.
Beyond Travel do not take responsibility if you rely upon this information and fail to obtain your own independent advice.
Cancellation and refund conditions are strictly enforced; therefore, we recommend that you carry comprehensive travel insurance which covers cancellation due to unforeseen circumstances or those beyond your control. Ask your Beyond Travel consultant for a choice of policies.
If you have a complaint about any aspect of the travel arrangements, you must immediately bring it to the attention of the tour leader or our local representative at the time to give us the opportunity to put things right. If you fail to do this, you agree that you waive the right to make a future claim against us in connection with the problem. If you notify the tour leader or our local representative of the problem and the problem is not solved to your satisfaction you must forward your complaint in writing to Beyond Travel no later than 28 days after completion of the tour at (otherwise you waive the right to make a claim against us in connection with the problem): firstname.lastname@example.org.
Services supplied as agent
Beyond Travel Group Pty Ltd, trading as Beyond Travel, is an intermediary and acts only in the capacity of agent for the suppliers of transportation, tour and cruise operations and other services over whom we have no control. All receipts, tickets or vouchers are issued subject to the terms and conditions under which services are provided. To the fullest extent permitted by law, Beyond Travel assumes no responsibility for loss, injury, accident, delay, damage or irregularity that may be caused to person or property in connection with the services supplied by third party suppliers.
Services supplied as principal
To the extent only that Beyond Travel is considered to be principally provides any services to you, then we will provide those services to you with reasonable skill and care. We will only be responsible for our employees in the course of their employment, and for our agents and suppliers (where we are not the supplier’s agent) if they were carrying out the work we had asked them to do.
We will not be responsible if the loss, damage, claim or expense was caused by the acts or omissions of yourself, of any other third party not connected with the provision of those services.
Please note that if the services which gave rise to the claim complied with local laws and regulations, the services will be deemed to have been properly performed, even if this would not be considered the case in Australia.
General liability limitation
Australian Consumer Law and corresponding legislation in other jurisdictions in certain circumstances imply mandatory conditions and warranties into consumer contracts (“Consumer Warranties”). These conditions do not exclude or limit the application of the Consumer Warranties. Other than the Consumer Warranties, Beyond Travel disclaims all warranties.
To the extent permitted by law, the maximum liability of Beyond Travel to you under these conditions, in tort (including negligence) or at law is limited to arranging for the travel arrangements to be resupplied or payment of the cost of having the travel arrangements resupplied.
Errors and Omissions
Every effort is made to ensure the accuracy and currency of the information in our brochures, errors and omissions may occur. Beyond Travel disclaims all liability to any party for loss or damage resulting from such errors and omissions
By making your booking request you acknowledge and agree that you have read, understood and agree to these Booking Conditions. These conditions cannot be varied, altered or waived by any servant, agent or representative of Beyond Travel or any other person providing services on the tour.
By making a booking request, you are deemed to have agreed and consented to all terms in these Booking Conditions and in any other documents provided to you by Beyond Travel or any other person who may have booked the tour on your behalf. If you book on behalf of another party, you represent and warrant to Beyond Travel that you are duly authorised to provide the agreement and consent the other party and you agree to indemnify Beyond Travel for any breach of warranty in this regard.
All monies paid by you to us will be the property of Beyond Travel and will be a debt due and payable to the relevant supplier (contingent on availing) once the services to which the money relates have been availed or the relevant booking cancelled (subject to cancellation fees). You agree and acknowledge that such monies will not be held by Beyond Travel on trust for or on behalf of you, and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.
The contract between you and Beyond Travel is deemed to have been made in the State of New South Wales, Australia, and shall be governed by the laws of the State of New South Wales, Australia. Any disputes shall be dealt with by a court with the appropriate jurisdiction in the State of New South Wales, Australia.
If any provision of these Booking Conditions is found to be unenforceable, then to the extent possible it will be severed from these conditions without affecting the remaining provisions.
These Booking Conditions do not affect any rights you have as a consumer under Schedule 2 of the Competition and Consumer Act 2010 (Cth).
